Patenting Upselling

As his Priceline stock continues to tank, it's good to see Jay Walker is out there continuing to make money off of ridiculous patents. The latest is his company called Retail DNA which apparently has a patent on the concept of the "upsell". So, all the upselling that's happened for however many years has all been illegal? You would think that prior art would destroy this patent pretty quickly. Wait until he goes after some online retailers for their upselling attempts.Thank you for reading this Techdirt post.
