Divorce By Cell Phone

from the different-cultures dept

A court in Dubai has validated the divorce of a couple after the man sent his wife a text message on a mobile phone telling her they were divorced. The text of the message actually read: "Why are you late? You are divorced." Apparently, that's all you need to make it official in Dubai (if you're male, that is). The couple is actually still together, so I'm not sure why the case went through, but I get the feeling that I don't really understand the legal system in Dubai.

Thank you for reading this Techdirt post. With so many things competing for everyone’s attention these days, we really appreciate you giving us your time. We work hard every day to put quality content out there for our community.

Techdirt is one of the few remaining truly independent media outlets. We do not have a giant corporation behind us, and we rely heavily on our community to support us, in an age when advertisers are increasingly uninterested in sponsoring small, independent sites — especially a site like ours that is unwilling to pull punches in its reporting and analysis.

While other websites have resorted to paywalls, registration requirements, and increasingly annoying/intrusive advertising, we have always kept Techdirt open and available to anyone. But in order to continue doing so, we need your support. We offer a variety of ways for our readers to support us, from direct donations to special subscriptions and cool merchandise — and every little bit helps. Thank you.

    Hmmm

I'm astonished that this is legal. I believ that you have to say "I divorce you" three times before it is final. (I am not an expert on Sharia law though!!)

    Divorce in Dubai

I do not understand the law very well in Dubai, but one of the reason the couple still together is that the divorce even if it is valid the man has to support his wife for 4 months after the divorce is anounce if after 4 months he still wants to get divoce, then it will take effect.

    Re: Divorce in Dubai

When people get married, they chose which one of the couple has the authority to divorce. By default, the man has this authority, but it can be the woman. Divorce is severely discouraged. Infact, in Islamic believe, it is God's least favourite of all the allowed rights in Islam. To divorce your partner, you have to have the competence, then say the words (I Divorce You) or (You are divorced). Couple have a certain number of month to reconcile after divorce but are only allowed to divorce and reconcile twice, after the third divorce, they can not reconcile as easy again.

I dont think the man in the above story can qualify as "Competent" judging by his action.

I haven't heard about the divorce via text, but I know that in case of uncontested divorce you may file for online divorce
Sure it would be cheaper, but would it replace the f2f lawyer remains questionable.
