Porn Operator Has To Check On Affiliates

from the bad-ruling dept

An operator of an online porn network has been told that it has to police its affiliate sites to make sure they don't have any copyrighted materials on their sites. This is a bad ruling. If the affiliates are breaking copyright laws, then they should be sued - not the network that ties them together. I would bet that many people won't necessarily complain about this ruling because it deals with pornography - but it could set a precedant that says that ISPs are responsible for copyrighted info that any of their users puts up.

This is actually an odd ruling for another reason.

Works covered by copyright law further either science or culture. Pr0n does neither so generally judges don't even hear copyright cases where either party is a pornographer. This is my understanding of the issue, IANAL.
