ElcomSoft Verdict: Not Guilty

Surprising as it is, it seems that the jury has come back with the smart decision in the ElcomSoft case. They've been found not guilty of violating the DMCA with their application that let people copy ebooks. Maybe it's a good thing that this was a criminal case where a jury of ordinary people could actually understand the issues and realize how silly the DMCA is.

    The jury *didn't* get it

    I read an interview with the foreman. The jury did believe that Elcomsoft's software violated the DMCA, but only found them not-guilty because the company didn't violate the DMCA intentionally. The fact that they put it on their website was what convinced the jury.

    The jury didn't seem to have any problem with the fact that the software itself should be considered illegal.
