Owner Of Stolen Sex.com Can Sue VeriSign

After years of fighting it, it appears that Verisign may finally need to face up to the fact that they screwed up. In just the latest episode in the sex.com saga, a Court of Appeals has ruled that Gary Kremen can sue Verisign for transferring his domain to someone else without his approval. All along the way, VeriSign has claimed that it's not their fault if someone forges a document, and they take no responsibility for it. The main issue in the case was whether or not it was actually possible to "own" a domain name. Verisign came at it from the opinion that you couldn't - and thus, you didn't really lose anything if your domain was transferred. However, the court has decided that domain names are property, and standard laws apply.
