Habeas Wins Anti-Spam Lawsuit, Spammer Told Never To Spam Again

from the surprising dept

I'm still confused as to the rationale behind the Habeas anti-spam haiku system (which we described last year when they launched). However, it appears to be working. The company has successfully sued someone for spamming while using a Habeas haiku. While Habeas will tout this as a victory for their service, I think it's more a sign of just how frustrated the judge in the case was with spam. Instead of just preventing the spammer from using the Habeas haiku for spamming purposes, the judge forbade the guy from sending out any promotional messages to anyone, ever. That seems like a pretty broad prohibition, and I'm not sure of the legal rationale to back it up. I'm all for stopping spammers, but I'm not sure I understand the legal ruling behind this case.

Thank you for reading this Techdirt post. With so many things competing for everyone’s attention these days, we really appreciate you giving us your time. We work hard every day to put quality content out there for our community.

Techdirt is one of the few remaining truly independent media outlets. We do not have a giant corporation behind us, and we rely heavily on our community to support us, in an age when advertisers are increasingly uninterested in sponsoring small, independent sites — especially a site like ours that is unwilling to pull punches in its reporting and analysis.

While other websites have resorted to paywalls, registration requirements, and increasingly annoying/intrusive advertising, we have always kept Techdirt open and available to anyone. But in order to continue doing so, we need your support. We offer a variety of ways for our readers to support us, from direct donations to special subscriptions and cool merchandise — and every little bit helps. Thank you.

sounds like just another reason for a spammer to file a lawsuit so spammers can get more legal rights. maybe we should keep our eyes on this one.

I'd say he got off light

If I were the judge, I would have had the spammer put to death.

No, I don't think that's a little over the top. It's not like I am suggesting we torture him... hmmm
