Dutch Workers Can't Be Sacked For Porn - Without A Policy In Place

from the makes-sense dept

While there have been plenty of stories of workers fired for having pornography on their office computers - or for sending it around via email - a Dutch court has now said that employees can't be fired for such actions without a written policy. This makes sense. If a company is going to fire people for such actions, then it's only fair for them to let employees know ahead of time what is and is not acceptable. The article also mentions that some new European regulations will prohibit continuous monitoring of employee computer use without a good reason.

Thank you for reading this Techdirt post. With so many things competing for everyone’s attention these days, we really appreciate you giving us your time. We work hard every day to put quality content out there for our community.

Techdirt is one of the few remaining truly independent media outlets. We do not have a giant corporation behind us, and we rely heavily on our community to support us, in an age when advertisers are increasingly uninterested in sponsoring small, independent sites — especially a site like ours that is unwilling to pull punches in its reporting and analysis.

While other websites have resorted to paywalls, registration requirements, and increasingly annoying/intrusive advertising, we have always kept Techdirt open and available to anyone. But in order to continue doing so, we need your support. We offer a variety of ways for our readers to support us, from direct donations to special subscriptions and cool merchandise — and every little bit helps. Thank you.

    Not too different here

That is pretty much standard practice in the U.S. as well - if there is no written policy against it (and it isn't illegal), then employers can't fire you "for cause". However, most states have "at will" so an employer can get rid of you for any business reason, so realistically an employer in the U.S. could use another reason, the difference being you could collect umeployment for being restuctured from your job and not if you are fired for cause.
