Nano Lawsuit Makes Apple Hyper-Sensitive?

We reported last week how a class-action lawsuit has been filed against Apple regarding the apparently easily scratched screens of the iPod nano. Now the company has told its service providers to replace any 5G iPods that exhibit any kind of hardware failure -- even as the result of abuse -- no questions asked. Just to emphasize, these are the new video iPods, not the nanos covered in the lawsuit. Could it be that Apple's trying to pre-empt any further lawsuits from disgruntled early adopters? Or did they need some help with beta testing? Perhaps all these issues are a roundabout way of keeping the iPod accessory market going strong.Thank you for reading this Techdirt post. On my two-year old PDA, the screen doesn't have a scratch on it because of those screen protectors. I know its been vouched here before, but just spending the extra 10 bucks to get a case is worth it.

Anyhow, what boggles me is that there would be any reason for a suit at all. The "scratches on the screen" issue is not something that just happened with out abnormal use of the product- as long as Apple doesn't claim they will replace any scratched screens in their limited or extended warranty then not stand by their word then I don't see grounds to sue...

I got a nano and I've been searching for some kind of a case for it that I would want to have on my iPod. The first third party cases I've found are JUST starting to ship (end of October). Considering that it was introduced on Sept. 7th that is way too long to run without a cover/protector.
I actually went to my nearest Apple store as soon as I got the nano (for my birthday) and they basically shrugged and said "Sorry, why don't you knit yourself a sock for it". Apple's obsession with secrecy is such that not even case manufacturers knew of the nano and are still running to catch up.

I see that as a pretty damned good reason to sue for replacement. And, since I've found out about it, I still haven't removed the plastic cover that came with the iPod. Although it's starting to peel off. I just hope that the case I preordered comes soon.

The premise being, that it is reasonable to expect to be able to keep it in your jeans pocket without getting any scratches, as long as you don't have other stuff in there.
So for one day, they carried an iPod nano around in their pocket (nothing else in the pocket). Afterwards they examined it and found that it was covered in small scratches.
This is why their is a lawsuit. The pocket sized music player is not up for the purpose of carrying in your pocket.

I have to agree with you on that point. Someone at APple should have realized that "hey, maybe people will buy a protection of some sort. Why not make one?"

Both of them had the iFP-799 players (linux dorks that just LOVED that it played OGG) and ended up getting rid of them and getting iPods instead.

No, you're wrong. Go look again and open your eyes this time. Belkin makes the same folding leather case for the nano as they did for the iPod Mini.
