Record Labels Suing Porn Websites For Using Their Songs

Michael Scott points us to the news that a bunch of big record labels have found their latest target for copyright infringement lawsuits: porn websites. Apparently, some of the websites that make their own videos have been including popular songs -- and some (*gasp*!) even show the actors lip-syncing along. It seems that the porn sites chose songs with... descriptive titles: Justin Timberlake's SexyBack, Michael Jackson's Don't Stop (Til You Get Enough) and Katy Perry's I Kissed a Girl. Assuming this ever gets to court, you have to imagine it will make for an interesting day in the courtroom when the "evidence" is shown.Thank you for reading this Techdirt post. I really think the music industry is hitting rock bottom. Seriously, I wanted to submit this story but I thought it might be rated M for Mature when it came to the content. Usually we try to keep it PG13. Ya know... For the kids.
Anyway, I'd love to see what comes of this but this might make a mess of everything the RIAA stands for.

Really this is a perfect example of why there should be compulsory licensing of music in movies: porn movies need music, but copyright holders would probably prefer to keep their music out of porn movies entirely rather than negotiate the licensing.

For that matter, the porn industry is doing great, too. They're taking full advantage of technology to reduce production and distribution costs and lower the barriers to entry. One could argue that the porn industry is the driving force behind a lot of the technology that the music and movie industries use. From home viewing and recording through to internet communities, porn was always an early adopter.

Further, use in pornography may damage the value of a work.
Either way, if film producers use your work, you deserve to be paid for it.
