Come to think of it, Sony is really the only platform-owner that I’m aware of currently requiring a number of third-party games to be exclusive to their platform(s). Sure, Xbox One and Switch may have some exclusive third-party titles (I haven’t checked if they have, but it wouldn’t surprise me), but for the most part, Microsoft and Nintendo seem to rely on other methods (console features like portability or power, prices, first-party titles, etc.) to convince people to buy their consoles.
Re: Sadly, Ya'll Are Missing The Larger Points of the Letter
It’s worth noting that many of us don’t buy that “cancel culture” as you articulated actually exists as you say it does. That a number of the people who signed the letter are hypocritical because they are rich and famous and/or try to cancel lessers is just an added bonus.
What amazes me is that, in the C&D letter itself, it specifically notes what markets their trademarks are for and the market the applied-for trademark by the law firm is for, and there is clearly no overlap as anyone can see. It’s almost as though Harper didn’t actually check what she wrote to see if it made sense.
I think it’s technically possible to have a corporation of sorts involving one person (a sole proprietorship or something) and with essentially the same name as the person in charge and registered in their name, meaning there could technically be a corporation named Tamara Harper with the only owner/employee being Tamara Harper registered under the name Tamara Harper.
What do you mean? It’s clearly used for parody/commentary in a legal filing (not commerce per se) regarding a trademark dispute between a law firm and a financial/social media advisor. Nothing questionable there. Is it that it’s sexist or something?
I’d say that the use in photography in a legal letter would also be outside the markets the trademark is reserved for and isn’t technically “use in commerce” to begin with.
Here’s the main issue with using Pullman here, as noted by the Supreme Court: a company town engages in activities (like running elections and writing legislation that governs the entire town) that is traditionally and exclusively deserved to the government. Nothing Twitter does or has been alleged to do falls within that very narrow case where an otherwise private entity is to be treated as a government entity for 1A purposes.
I feel like a lot of people forget that §230 also protects users of a service from being held liable for others’ content. True, this wouldn’t apply in this case (Japan and IP law), but it’s still important to remember. I wouldn’t be surprised if the DMCA has a similar provision, but I also wouldn’t be surprised if it doesn’t. Still, I think it’s generally accepted that vicarious infringement doesn’t extend that far in the US.
I don’t recall any of us supporting communism or claiming to do so.
Communism is more of an economic policy like capitalism than a form of government like a dictatorship, one which has never actually been put into practice because greed exists. That the only forms of government that have even claimed to be communist have ended up as totalitarian dictatorships doesn’t inherently mean that the one necessarily leads to the other.
There’s also fascism, which inherently leads to a totalitarian dictatorship but is actually quite different from communism in every other way.
There exists a large amount of middle ground between a capitalist dictatorship and a “communist” dictatorship along with the many practical combinations of economic forms and forms of government that do not involve “government agents in unmarked vehicles grabbing people off the streets”.
Wait, didn’t he declare bankruptcy? How did he get the funds to acquire the rights to anything while behind bars? I think that he might just be digging himself a deeper hole.
As someone who not only has asthma but also has a number of family members who have asthma, I find it particularly offensive that she claimed that her asthma kept her from wearing a mask.
Also, lady, the uterus has nothing to do with respiration, and chiropractors—assuming you believe they do help—aren’t much help when it comes to respiratory disorders, especially ones that might be triggered or exacerbated by wearing a mask. Nor do either of those things even relate to the symptoms you claim to be having. Also, “mask acne”? Really?
Actually, it’s more like the entire police department smacking around one peaceful protester (protesting against some dumb law or war or something) to stop a completely different peaceful protester from saying “defund the police”. By which I mean that it would both be overkill and would do absolutely nothing to solve even the perceived problem, and it makes absolutely no sense why they even thought that it would work or be a good idea to begin with.
That doesn’t change the fact that fascism is far-right by the current definition of both terms in political science and that there is a difference between fascism and communism. The traits they have in common/where they meet is totalitarianism. Whether you think that difference is strong or weak is immaterial to my arguments.
