What is the percentage chance that if, instead of this NY couple, the "offending dancer" was Kate Upton in a bikini, she never would have been arrested.

The problem with your argument is that none of the angst by the parties in the article has anything to do w/the rings. It has to do with the name Olympic. If the USOC had only had an issue w/the rings, this story would have been written very different.
.....And? Nations with nuclear weapons, particularly those with large stockpiles of them, are not a threat generally speaking.
With two rather notorious exceptions, nuclear weapons have always been a defensive weapon ensuring the minimalization of war, not an offensive threat....
"Right now, it looks like (for unclear reasons) this provision is just limited to Russia"
Unclear? Perhaps you haven't noticed yet, but Congress is generally somewhere between 15-30 years behind the general public it "serves" (HAHAHAHAHAHAHAH!) on EVERYTHING.
Thus, Russia is still the number one foreign rival (Just ask Mitt Romney), Movie/Music CDs MUST be protected (Just ask Barack Obama), and gay people are icky (Just ask an unfortunately large number of...well...everyone in government).
Meanwhile, the general public knows our rival is China and Pakistan, movies and music can be made to magically appear on all kinds of shit, and if gay people want to get married most of the public couldn't care less.
I swear, our government is one of those "who is walking who, the dog or the owner" questions....
Attention idiotic music label: nothing could scream "you took down the Romney ad for political reasons" more than you pretending not to by then later going around multiplying takedowns.
I mean, perhaps from a broad standpoint your making the point that campaigns can infringe is fine, but this case just doesn't seem like one of them. Too short of use, not the artist's recording, clearly used for commentary....I'm just not seeing it....
Uh, I did see that case as counsel instructed, and I find it's applicability extremely lacking. In that case, both instances under review included direct recordings of either the music and/or lyrics performed by Henley. That isn't the case here, where (unless we're talking about different videos), Obama is singing A Capella.
Secondly, in that case, DeVore relied on a Fair Use argument hinging on his campaign adverts being parodies, which was stupid. If he had simply said the use was used as commentary, likely they would have prevailed.
Unless I'm missing something and Romney has already claimed "parody fair use" in this case, I find your citation to be of little to no relevance and ask the court to summarily "de-sack" you as punishment....

"LOL! Are you suggesting Random House would be promoting this guy's book if the book wasn't protected by copyright?"
LOL! Are you suggesting that his book wasn't copyrighted immediately upon completion, so the entire question is moot anyway? BTW, you are aware that there are book publishers, big and small, that promote free eBook libraries, lax copyright enforcement, etc. So....your point?
"This guy's business model for this book is totally copyright-based."
So? Again, we're not abolitionists. I'm certainly not, and I write for this site. What's your damned point?
"And fact is, if someone were to violate the copyright in this guy's book, Mike would blame this guy and not the person who violated his rights."
Uh, no. If someone violated the copyright in this guy's book and he went all legal and ballistic rather than trying to engage potential fans to get them to pay for the work, Mike/me/Techdirt would say there's a better way. Wrong again....
"Techdirt is a pro-technology"
Yes.
"pro-piracy"
Mmmmm, no.
"It's all Pirate Mike knows."
Uh huh. Let's compare his and your resumes, shall we? I'll even throw mine in the mix as well. Where can we get yours?
"But, still, it's too, too funny that this guy's business model is full-on, undeniably based on copyright. Kudos for being a two-faced sack of shit, Mikey."
It's a funny position to take, to decry our including a great work of culture on this site because he happens to own a copyright on that work....after people on your side of the argument worked so hard to ensure that EVERY DAMN THING HAS COPYRIGHT ON IT AUTOMATCALLY. More importantly, not all of us, and I would probably say not even Mike (though he can disagree w/me if I'm wrong), are copyright abolitionists. I'm certainly not.
So, what we have is your side creating mandatory rules, our side liking authors that write about how overblown those rules are but being forced to follow those mandatory rules, and then you put your fingers in your ears and stick your tongue out. It must be nice, to live in this place you live in, with people in your life so devoid of thought and backbone that they never challenged you to - AGAIN - make an actual cogent point....
