Trademark crazy professional sports needs to pause for a second, step back and see the bigger picture.
Stop suing over every little trademark issue that you can imagine or contort into a lawsuit.
Instead, consider. There is a better way forward.
How much easier would it be to simply patent the business method of suing over sports related trademark infringements? Then you could make money while everyone else in sports continues doing what they are already doing.
It is also good for the economy in that it helps keep patent troll lawyers employed as well as trademark troll lawyers.
I'm 61% joking. But one way is like how in Babylon 5, the EarthGov president Clark simply dissolved the senate and put Earth under martial law.
All you need is someone who is completely self centered, on a power trip, has no grasp of, nor respect for the law or even what is right for any other person outside of him/her self.
Don't think it couldn't happen here. I don't mean to invoke godwin, but I'm sure people had no idea what was going to happen.
We read right here every day about a world that seems to be going insane.
Every time I come up with what I think is a sarcastic, cynical paranoid raving, reality turns out worse.
Don't just complain like the horse and buggy vs the newfangled, unreliable, noisy, smelly, difficult to start automobile that more and more people are buying.
Adjust your business model.
Is big bad Amazon building a local distribution center making you cry? You could have been ahead of the game on this if you have any vision.
Maybe you should get into the technology game.
Build a big web site that makes it easy to shop online. Integrate the site with your stores' inventory systems. After all, your retail store fronts are also -- ta da! -- local fast delivery warehouses as well! Your site would know exactly what and how many you have in stock, and the nearest location to deliver it from.
You could build a software delivery planning system that offered over night delivery. Or possibly same day delivery if you order before noon.
This item qualifies for low cost same day delivery if you order in the next HH:MM minutes!
Maybe you could find a mutually beneficial arrangement with local delivery companies, such as, oh, say, UPS, FedEx, or even (gasp!) the USPS.
Or, maybe not. Maybe you can get a law passed or something. A past way of doing something is being destroyed! We need a law! Or a president that will abuse power to fix this!
Lots of people pointed out that Trump perhaps couldn't do too much to libel laws (the Supreme Court and the First Amendment has that covered)
Not if Trump removes and restocks the supreme court justices.
If congress doesn't like it, he could just dissolve congress because it acts as an inconvenient impediment to his administration's agenda. A mandate which he received when everyone voted for him to be president. After all, everyone just loves Trump. And anyone who doesn't is just a loser. And if some people don't want a Trump administration, then he'll make it longer -- and he'll make them pay for it. His will be the most bestest classiest administration ever. Believe Trump, when he says he knows administrations. Everyone will just love his presidency. And loving it won't just be the right thing to do, it will be the law.
No. The mantra they need to be continually clubbed over the head with is 'dumb pipes'.
That's it. Just dumb pipes.
Competition will result in finding the most cost effective way to deliver the best dumb pipes. Rather then many, many other countries having far superior internet access, maybe the US could have decent internet at a decent price.
Also, no content from the providers of dumb pipes. It seems that they just cannot resist trying to screw everyone over if they are allowed to do both dumb pipes and content at the same time. If they can do only one or the other, that would eliminate trying to use one to advantage the other while harming consumers.
Even if dumb pipes can't have much competition, the content needs serious and real competition. We can't have hollywood squeezing out new forms of media, entertainment, or even just low cost independent films. Consumers should have equal access over the dumb pipes to connect to whatever source of legal content that they want to connect to without hollywood being able to stop it.
Continuing to use a euphemism such as PAE instead of the words 'patent troll' says a lot. It suggests one has not fully embraced or even grasped just how damaging patent trolling really is. Blindness to see the true damage left in its wake.
How about let's compromise and use PTE (Patent Trolling Entity) which is perhaps more friendly than just plain Patent Troll.
Intellectual Vultures is the biggest PTE around. To nobody's surprise funded by an ex Microsoftie.
We are notifying you that we are going to hold on to your property which we have seized in the expectation that in the future the necessary technology will be developed to allow us to determine that there is more than probable cause to open your property for a more complete search.
But how could you want to abolish copyright when it is such a fantastic tool for censorship?
In a world without copyright, how would HBO keep people from speculating about what might happen in an upcoming episode?
Without copyright how would a major motion picture company or record label be able to file a DMCA to take down its own promotional materials that its own marketing people put online?
Web Sheriff demonstrates that if someone says something unfavorable about you online, that the DMCA is the first tool to reach for? Without copyright there would be no DMCA.
. . . people of reprehensible moral nature brazenly infringed copyright by letting multiple persons read the same newspaper. This should still be a crime, even in the case where different persons wanted to read different sections. And it is much worse when two or more people laugh at a single copy of the comic section. Or the travesty of two different people identifying a movie that they want to see -- by looking at the movie section of the same newspaper!.

Yes, really. I'm not voting for him. But it is like watching a slow motion train wreck.

The Right to Not be Criticized
I think we have a winner. You, sir, have just discovered a new right!
Now we will need to get all web sites on the planet to enforce our national notion of the right to not be criticized.
