If the MP3 format was 'copy written' and controlled by one entity - there's pretty much no possibility that it would be - by far - the most predominant format for music out there.
Same could be said for the format CD's and DVD's use.
If... for instance, you could find a way to generate power for free - there's no doubts that oil companies, coal companies, power companies would SCREAM.
But I don't think any amount of screaming would stop people from making their own power...
If that in fact was the case; many would praise that as one of the best things that have ever happened to humanity. Odd how music, art, and literature are widely available on the Net - yet, the focus isn't on that fact - it's on how some corporations are losing money..
That's because... like other industries - but maybe more apparent in the apparel industry: It's about QUALITY not patents.
In clothes - a lot of people aren't really too picky and lean on quality before anything. I would be one of those.
I can find 200 different designs on jeans, same with shirts, shoes, etc..
And while the design does play a bit of a part, I'm not too picky - but I do want it to last a while. There are some name brands I avoid due directly to that.

No - that's an ok analogy. If the charge was specifically "First Degree Murder" - then you would in fact be found innocent of that charge.
Of course; after that - it might end up being manslaughter, etc - but for the 'accused offense' of Murder in the First degree, it would not apply.
