Just because the courts have been sketchy on whether or not you need a warrant doesn't mean that the procedure for getting one has changed. It's stupid, especially in a case like this, to not just go that extra mile to be on the safe side.
Care to back up that confusing bit of... ehm, logic? What makes you say that?
Praising a person/organization when they do things you approve of is not evidence to say that you would praise them if they did something you don't approve of. That's just...
HAVE they filed an actual lawsuit though? Isn't the common tactic to NOT file any actual lawsuit against any individual, since that would be to costly?
I think that is going to be a big clincher, whether or not there actually is an ongoing lawsuit.
Also, do you know for a fact that is how it works in Germany? I have no idea, but it would be a bit ironic if you don't have any more insight into German law than the previous poster.
I wonder how long it will take before someone makes the connection "running a website with infringing material (or maybe linking to it or something maybe)" and "mobster"?
What do you mean "complete lack of enforcement"? Ever heard about something called The Pirate Bay? Whatever the name is of the poor people who ended up having their lives completely ruined by lawsuits? Or Dajaz1?
"Sticking to the line "we promised" isn't a viable business model."
If "we promised" means "we signed this contract", then yes; sticking to it is a viable business model. Or more correctly; breaking the contract because you miscalculated is NOT a viable business model - it's breaking the law.
Re: We can't tell which businesses keep their promises until the business ends.
Sure you can tell which one is keeping their promise. We won't know until the end which one kept their promise ALL THE WAY, but we can know who has kept their promise SO FAR.
It's just like with the dieter; no one (may except for you) actually think that they mean that they will keep the weight off for the rest of their lives, just that they have done so so far.
The thing that strikes me is the fact that no one expects any money to change hands here, and yet they (IFPI/RIAA/etc) can't seem to find the will for a free PR-win by saying that ALL the money (which is zero) will go to the artists.
I think they are sending a message here; "we REALLY hate artists!".
You are confusing the labels with RIAA/IFPI (wasn't MPAA involved as well?). The labels may be able to make more money by moving on into the 21st century, but IFPI and their likes all know that they have no place in this world.
I think that these lobbyists are actually defrauding their "members", in order to stay somewhat relevant.

'Cause I don't think so.
Plus, I would think that the transaction of money means you are far more "on the hook" for original promises.

If the government has such problem knowing what is allowed, then they need to fix the laws (not the Constitution) so they are clearer.
