You have to admit though, it's kinda hard to hide a weapon when you are naked, and if you can hide a weapon while naked, you either need to lose weight or can have a nice career in porn.
I'm reminded of some testimony during the Mickey Mouse Copyright Extension act (Sonny Bono) where one of the persons giving testimony said copyright should last forever minus a day, that way it's still constitutional being "a limited time".
The easiest way is as Rose put it, just no. Having exceptions like this really is silly when in the same breath we say "how are they supposed to know the difference between permissive use of copyrighted material and otherwise" and than what some would call art and pornography. Sure you could allow users to try and police this with a "bring it to our attention" button but as we've seen with the previous rick roll story all of these systems can and will be abused.
This failed lawsuit gives the next person a track record of misguided lawsuits to point at to establish a history of baseless lawsuits in an effort to get it thrown out.
