I assume Honda didn't actually buy t-shirts with the slogan on them, but actually drew them in their video editing program or whatever. Would it make a difference if they had purchased a bunch of shirts and used them in the ads? Would that shift the liability to any t-shirt vendor who used the slogan without a license? Honda probably still has the deepest pockets, though.
I generally agree with what you're saying, and I wish more people would take advantage of other licenses beyond standard copyright. And yes, as more and more people do that, more and more works will become part of mainstream culture that use these licenses.
But it will take time, and meanwhile we have to deal with what we've got.

Remember that many people who spoke at WFUD (and many more who didn't) use remixing and mashups and things that may not comply with copyright laws for more than just art. I agree that there is tons of good art to base your work on that isn't held back by copyright, but if you want to make a statement with your work, you often need to use samples that are well-known to the public.
Using well-known works can provide necessary context to a listener that you'd have to spell out if you used an unknown work. Even if the unknown work was better quality, you might have a harder time getting your message across.
Mike, I don't know why it's so hard for you to understand. DRM enables new business models.
In this case, the new business model is technical support at German movie theaters. Think how many people can be employed who would otherwise be living on the street, all because of DRM!
I'm trying to think of an example of how this might work for fiction, and I just can't do it. For non-fiction (O'Rielly books are a good example), I can see it, sort of, though I think a subscription model would work better for them.
But fiction? What in the world are you going to add to a fiction book to make it worth buying? Once I've read the book, I'm not going back because you cleaned up a few paragraphs in chapter 6. Maybe I'm missing something.
Though I loathe Apple and everything they do to pretend they still own something they "sold" to you, I'm sure Apple is just as pissed about this as you are.
Wouldn't a friendly, 'Hey, that video was stolen, could you please delete your tweet referencing it?", be a nice first attempt? The knowingly bogus legal threat could come later, if the person refused.
Yeah, not blaming you. It sounds like every other moderated panel discussion I've ever seen. The moderator has to get through the talking points even if the current one isn't finished.
Good thing you have your own "panel" where you can finish the conversation.
I sincerely hope that it wasn't any sort of sting. If the FBI is seeding file-sharing sites with child porn, or even tracking child porn that's already out there, then they are harming the children they claim to protect.
I can't think of any sting scenario where the children involved would not be much better served without the sting.
