That must be the only solution. Make it illegal to listen to music, because you make a copy of it in your head, and clearly we don't want that. You could for instance whistle the tune or hum it, without paying us, the rightful owners of the works. The gall of those pirates, humming our copyrighted works. Tsk tsk, they should be shot.
According to all 'checkout' pages I've seen on Amazon, I've never been eligible for their free shipping program, causing me to not use it. (because shipping with Amazon is hideously expensive)
But then again, I live in The Netherlands and not in France.
That one rebuttal is poorly written, and relies much on the words of the bill's sponsor, who doesn't even seem to know what the law was about. ("he had to check in with policy staffers before confirming [that the broad interpretation was incorrect]")

Have you even looked at the law itself and tried to interpret it? Did you come to the same conclusions as Ars.Technica?
If so, then even then it's a bad law, because it has many different interpretations.

Why would it have to be? The © is automatically implied if a work is released, though it's hard to see how posting a C&D letter is infringing.
