Um.. wouldn't it be the Courts decision to determine if a website falls under Safe Harbor rights? DMCA notices are sent to the provider who can forward them to the users in question. If the Copyright Office is acting as a middleman in this and receiving notices from rights holders then forwarding them to the service provider.. its no wonder they are overworked and over budget.

Yes, I've seen little notices on things like Newegg and other places I have bought online from that say 'X% tax included for residents of State A.' But if Netflix is in Seattle Washington (I've no idea where it really is..) and cities and counties in California are charging tax, isn't that interstate commerce?

The thing I hate most about the FCC not acting on these is that as soon as they do (if they ever do..) come down on the providers they will get taken to court, yet again. They will cry "over reach" and "we have been doing it like this for years and they never had a problem with it". When it comes to corporate giants like this you have to take a firm hand early and often because otherwise they will take the inch you give them and run a thousand miles with it.
How do you know the woman wasn't here legally then had her greencard/visa/passport expire? Indigent border crossers typically can't afford a lawyer to fight their deportation case for them.

So if the Senate Hearing obviously took them to task for wrongdoing, can the FCC impose fines of their own. They wouldn't even have to do any research, they could just cite the Senate research.
