Being that we are talking about Roca Labs here, I wouldn't be surprised to see if they filed a new lawsuit to have the Judge who ruled on this motion removed due to "extreme prejudice" against Roca Labs.
I am seriously starting to wonder if the CEO of Roca Labs and the CEO of Suburban Express bowl together and share ideas on customer service.
This is not about copyright enforcement, it's about enrichment. Plain and simple. Do these guys have an interest in going after those that leaked the movie...no they do not.
The whole model these suits are based on never ever is to go after the source who leaked the movie, it is always about going after those who downloaded a fraction of the movie so tiny it isn't even fathomable.
They basically collect a brief piece of the movie from an IP address and then that is the basis for their claim.
It's beyond a joke really, this is nothing but the legal version of blackmail and extortion
While getting the trolls to explain it in their court documents is a good step, I am not so sure many Magistrates or Judges will understand it.
If you look at some of the information used to file for the patent , there are a endless stream of applications where there is a bunch of supposedly technical gobbledygook that drones on and on without really specifically saying what said patent does.
Is this a great step. yes I believe so. The problem is that some courts are so over burdened that they just seem to rubber stamp anything that comes there way. Lets hope this helps.
Wow! So I guess you can use a gun and badge to rob people legally now. And the Police wonder why the public have such a level of mis-trust where they are concerned.
FACT has their hand so far up the PIPCU backside that they can move their lips. Does anyone really take ANYTHING that the PIPCU puts out in their press releases seriously?
The PIPCU is nothing more than a Hollywood paid for hand puppet.
The more the PIPCU try to justify their branching out from parking tickets or whatever they were doing before FACT came along, the more they look like an inept law enforcement agency that got caught up in the excitement of doing something besides handing out parking tickets.
The CPS basically looked at the case and the alleged evidence which was not provided by the PIPCU but by FACT which is a private entity and not a law enforcement agency.
The idea that the PIPCU went on a 200 mile journey based on evidence provided to it by FACT, on an investigation carried out by FACT and then proceed to arrest and charge an individual based on a information gathered by a FACT screams stupidity.
The PIPCU seems to be void of the ability to see that FACT and it's investigation and alleged evidence acquired are biased towards their own agenda.
The CPS know damn well there would be more than a few questions of why is the PIPCU going way out of their jurisdiction to arrest someone based on a private entity's investigation and evidence.
I would have to be of the belief that even a beginner law student could get a case like this thrown out of court just on the mere perception of bias on the Police & FACT partnership.
I wonder how the UK citizens like the idea of FACT running around playing copyright cops with taxpayer dollars for private companies.
The PIPCU head ought to be shuffled out the door permanently for his decision to cross the line from law enforcement to FACT's legal arm. What we still don't know is if the PIPCU are deriving a financial benefit from FACT for their enthusiastic copyright enforcemnt policies.
It will be interesting to see if this fellow who was arrested decides to sue the PIPCU and FACT for malicious prosecution.
The more I read about this case, the more I get a Prenda like sense of Deja-vu in how the legal arguments from Roca seem to be filled with more filler than substance
The fact that they are suing people who were former customers many years later just adds to the air of desperation of Roca's case in my opinion and seem to be more concerned with the statues of limitation running out than actually saving fact and getting out of this mess.
Honestly the bad publicity that is going to surround this case almost reminds me of the KlearGear mess, in that trying to hold people to a policy that is coercive at best is just bad for business.
If your product isn't what is cracked up to be then people are going to complain about it. Maybe if they actually offered refund peoples complaints wouldn't be so bad.
If people are saying this product didn't work for me and I cant get a refund, then you cant expect them to sit by and just flush their cash down the drain and be all quiet about it
It would seem this is more about silencing the critics who say the product didn't work, as it may effect future sales. I guess it is easier to try and quiet your detractors then to fix your product
That little rebuke to Voelker in this decision is all because of the slight he made before the appellate court when they were arguing the appeal.
The three Judges weren't impressed when Voelker made about the court that brought down the Judgement, and even after the Judge made mention of it to Voelker, he just wanted to slink away without an apology to the court for his remark.
Judges have a long memory for things like that, and them making the comment in this decision makes the point quite clearly they didn't appreciate the remark or forget it.
I am hoping that time will soon come where they one day are in a cell rattling the bars while giving their fellow inmates the story of how they have been so wronged by the courts
Remember this is the case where John Steele was whining how he didn't have the ability to pay any Judgement when the Judge order them to pay costs which is what this appeal was about.
Then SJD discovered that John had started renovations to build a Pool, Spa & Deck to his Miami home and the document used for the permit we're filed with the court in Miami's Dade County Court:
I feel bad for the contractor. Apparently he never Googled the name John Steele or he would have got a glimpse of what John is like when it comes to paying things, like court judgements and stuff
Steele, Hansmeier & Duffy strategy has always been to score settlements from alleged copyrighted movies. This was their whole agenda.
John Steele, Paul Hansmeier & Paul Duffy whole strategy in every case where Prenda and it's lawyers were called on the carpet to answer to the court has always employed the same strategy: Deny, Deflect, Delay
Deny: We weren't involved Deflect: We knew nothing about it Delay: We never got served thus we deserve a do over
These guys deserve what they get. They made millions doing this and their plea's of poverty are laughable.
So these guys have shown an ability for a long while to play fast and loose with the facts and it's about time they have to pay.
I wonder how many poor ISP subscribers had to take a mortgage out on their house so these ass clowns could score a quick 5K.
What would really be sweet is if Carolla's legal fund grew even bigger or doubled. That would scare the hell out of Personal Audio CEO Brad Lidd.
As for Personal Audio CEO Brad Lidd's complaints about Carolla's fan's contributing to the defense fund and Carolla not wanting to drop the suit. Tough shit! You brought the suit on, so man up and face the consequences Your so confident in your patent, then defend it at trial.
I am of the opinion that old Brad fears he and his patent trolling days could be at an end after this trial, and I sure hope that will be the case. I wonder if Adam is still taking donations, if so I will donate just to see Brad and his Patent take a beating in court.
Does anyone know when other countries governments are going to take a stand against the finger puppet Obama Administration that is run by Hollywood and the Copyright fanatics within their industry?
" This certainly seems like one of those issues that's destined for the Supreme Court in the near future "
While that would be nice, the U.S. Supreme Court seems to be content with the Government and it's agencies breaking all kinds of laws and violating constitutional rights.
It's not like they have no idea what's going on, they just seem to be afraid to rule against the government or set down rulings against this mess that are based on law, the constitution and peoples rights.
If there isn't interference from the White House and it's spy agencies going on, I would be shocked
And here I thought that the heir spying, I doubt this Government had missed some type of communications they wanted to violate a persons rights to.
If you were wondering just how out of hand the Government has gotten, I don't even think that this ranks that high.
I can't wait to seem how many people that are incarcerated are going to be filing appeals due to their rights being violated. I am sure that the ABA is going to have a shit when their suspicions have now being confirmed.
At least AT&T is consistent in their failure to live up to their promises and expectations.
I feel sorry for Direct-TV customers, if they think their service sucks now, wait till AT&T starts issuing directives and changing things in the name of cost savings

Prenda likes to use every legal tactic in the book and so Does Roca. Prenda has filed lawsuits at it's critics, Roca has files against it's critics.
Prenda has clients who don't exist, Roca has celebrity testimonials that don't exist.
Steele would be available since his legal career is non exsistant these days, it's a match I tell you.
