The recording industry has a right to defend its property in any legal way at its disposal. It's their music, they paid the artists for it and you do not have the right to download it for free any more than a stranger has the right to come into your home at random times and use you computer.
However, the RIAA is fighting to maintain a business model that will no longer function. Artists can record, mix, publish, and distribute music/video by themselves using inexpensive equipment and off the shelf software. The recording industry has made itself irrelevant. In a few years the RIAA and any record label that does not adapt will be gone.
The next big and influential recording label will be the one that embraces internet downloads and add so much added value that it becomes the brand of choice. Apple is the obvious leader.
Record companies have to provide more than an album by a corporately created band, that is based on recommendations from a focus group, with only one good song, on a CD that skips on three tracks, in a "crystal" case that breaks on the first opening.
The recording industry has received hundreds of dollars from me due to this this CD/DVD tax they somehow convinced the Canadian government to levy. I have only used my purchased CDs or DVDs to make a (very few) backups of what I had already paid for or for backing up computer data. The record companies owe me and many others a large amount of money. I do not believe for a moment that the artists and song writers get a single penny from the CD tax. If they do get most of the money I would be OK with it. Can anyone give me an example of a Canadian artist that gets any CD tax money?
Hopefully this is a temporary injunction in effect only until a concise evaluation can be made. Works derived from other copyright material is allowed but there are limits. An author can't expect to get away with writing a book about a James T. Kirk who captains a star-ship Enterprise and call it a derived work.
My cable company charges me for not using the television services (I simply use the free broadcast on the air) and just the Internet access. The joke here in Canada (where this is standard practice) is that "no one dares cancel the cable completely - we couldn't possibly afford it" (credit: Royal Canadian Air Farce).

True, that's why I always set up a fence barrier at a job site in a public area - and people still walked through where we were using the crane. I had to threaten a couple of people with arrest because if they were hurt I would be fired and these idiots would get a big, fat settlement for being idiots.

Delinquents that do drugs and steal get sent to a first class wilderness camp for free (yes I understand that this is for behavior modification reasons but and is cheaper than future imprisonment but it still chafes). A person saves money and plans ahead for retirement and then is taxed on those savings so those that partied and blew every cent can have free money when they no longer work.
Society should be designed so that the strong and rich share and provide for the weak and helpless, not the stupid and selfish.
Why do Americans almost always whine about getting caught when they break a law? It's one of those things the rest of the world can not stand about us. The rest of the world breaks the rules too but they eat the punishment and don't complain like 13 year old girls.
Pay attention to your driving and stop following so close and stop pretending your faults are caused by others and you might start to be a decent motorist and passable human being.

Purely speculation: Jammie Thomas has no assets to worry about and is refusing to settle out of a sense of moral duty and / or an acquired taste for minor celebrity. The RIAA's behavior is the lashing out of a dying industry with a lot of money and lawyers.

As long as it is clear that the character is being used out of the original context or is a parody then copyright is not an issue.
