Let's just put this in simple words that Witte could perhaps understand:
Twitter has a very specific legal agreement each which helpfully describes what, when, how and why Twitter will do stuff with your data. It is called a "Terms of Service" which every user must agree to when creating an account.
The only Terms of Service applicable to being a citizen of this nation is supposed to be The Constitution of the United States on America.
Let's not forget that not terribly long ago, we all used wires classified as Title 2 services to access the Internet.
It was called "dial up." And you'd get exactly the same speeds over those wires regardless of whose number you dialed. Title 2 regulation of the phone lines didn't affect your ability to vet the content you wanted. The Internet was BUILT by people who could dial in and basically do whatever they wanted.
Why should a wire in 2014 be so fundamentally different than in 2001 that Title 2 would KILL THE INTERNET any more now than it did then?
I think many of the people involved in this argument are missing an important point:
Plane flying 150mph
Something happens
Plane no longer moving at 150mph
Kindle = missile
I think this is a significant safety concern aside from any electronic interference, etc.
Given that the chances of something untoward causing a fairly significant, if not catastrophic, deceleration are significantly increased during takeoff and landing, it seems to be prudent to stow lose items safely during these times. It doesn't take much of a velocity change to rip something from your hand.

Only one party here is violating it.

We've seen what happens when Title 2 applies...
