I'm not sure of the status of MacMillan at Barnes and Noble, but Sunday they had The Politician eBook at $9.99, the price too low for MacMillan at Amazon. Today, that eBook is missing at bn.com.

I would have bought several Kindles by now if the books were not copy-protected (DRM'ed). As it is, I have bought none. I imagine there are a few hundred thousand other Amazon customers who feel the same way.

I disagree. There is a huge difference between software and hardware. Patenting a software technique is like patenting a method of taking out the trash. Patenting hardware is like patenting wheels on a trash can. You should be able to patent the invention of wheels, but not the idea of getting up in the morning to take out trash.
While I am strongly against software patents and stupid patents in general, the independent invention defense would allow almost anybody to copy a patent and claim independent invention. I think it's unlikely to happen.
In many cases I'd say at little more diligence is due. Some VC people tend to rely on relationships and overall impressions a little more than tangible proof.
I would rather see my pirated software sold for a goodly amount rather than just a few cents, even if I'm not getting any of it. It shows a good demand, potential market, and possibility of upgrades. Just like Lily Allen.
