Actually, artists in general have never made money. In the last 80-some years a few multinational corporations have given massive wealth to a very select group of people in the hopes that they will change the perception of art as a poor mans gig, and give it the illusion of promising wealth. They then proceed to shove that precious few (less than 1% of 1% of even signed recording artists get rich) in front of all of us telling us that without the copyright-driven label system no one would make money.
Artists apparently have the right to copy that which they see around them, and yet I dont.
Or as Eejit said, the right to FREE speech. And by the way, free isn't an analogue concept, with varying degrees. Its very much digital, on or off. Any restriction automatically makes something not free. So yes, they have free speech, i do not.
Because theres 2 interpretations, the one that was originally meant when the statute was written "Performances in public" and the one that is used to sue people "Performances for the public". The second is merely a twisting of words to win lawsuits.
Yeah, they are getting into it which is sad too, but on a scale of the attack they could make on anyone moving information over a network or building an operating system, its hardly anything.
Because thats the nuclear option, because of the Desktop OS market... but dont forget, for every 'scroll bar' patent that apple owns, MS owns a 'TCP/IP'...
Regardless, they both own so many its crazy, but if you boil it down, they arent non-obvious to anyone who understands... they just patented them when only a dozen people understood.
Re: Apple Wins Europe-Wide Blockade Of Samsung Tablets; Guess Which Tablet Apple Is Scared Of Most?
What in an iPad did Apple invent? The tablet? Sorry, Toshiba and MS did that 10 years ago. The Smart phone? Palm and MS 9 years ago. The mobile operating system based on icons and applications? Sorry, Palm and MS there too, 12 years ago. Capacitive touch screen? Again, HTC and Motorola did it first (WinMo6 Pro phones). MP3 player in a phone? Sony and Motorola. I could keep going. Basically, the iPhone/iPad platform are a culmination of the technology of the players in the market that actually mattered when they were invented. Apple was still struggling with NeXt at the time... So I ask, what, exactly, did Apple 'invent' that Samsung stole. Different CPU/GPU, different OS, different UI, different EVERYTHING. The only similarities existed before the first iPod shipped.
Apple is opening a can of worms that I don't think it will ever extricate from. They make MacOS, which is based on LOTS of code from other people, most of which is patented by Microsoft. MS doesn't really do the patent trolling thing, but as the Operating System patent wars start, guess who will end up the winner? Hint, its not Apple, Google, HP or RIM.
Re: The court has clearly never run an email server...
This. This should NEVER be an issue. If, in 4 days, you cannot handle a simple quota problem then theres a lot of other stuff you probably arent handling properly anyway.
Did you write this? Because your wrong. The damage was NOT caused to the computer, which the statute covers, but to the business, which it does not. Try again. And if you have a law degree, I weep for you.
Basically if not having the staff to deal with the influx of communication was liability on the person sending the communication the ENITRE legal system would crumble. The best defense to any suit would be to fire your lawyer and say that the constant influx of motions and suits is harming your business because you dont have anyone to deal with it.
So which email was the problem? The 101st? The 1001st? The 100001st? Thats the issue. Also, the business was never harmed, they just didnt have the manpower to sort through their email. Thats what harmed the business, not the emails themselves. Notice the server was never brought down. If im emailing someone and they tell me to stop, and I keep emailing them, am I hacking their computer? No. This is most certainly harassment, but civil harassment, not 'hacking'.
Sean Parker wasn't an entrepreneur, he was an employee!!! Just because Aaron Sorkin said he made Napster, doesnt mean he did, and you'd think TechCrunch would know that!

On that note, how many 'rights' does an artist have, and why do they have more than me?
