The thing is, people here are missing the point. The legal of actions committed by police are determined by how the police actions are used in a court of law.
That is very wrong, from a Constitutional perspective.
Let's put it in terms of murder: if a person commits a murder that is never discovered, did a crime occur? Of course it did, an it occurred at the time of the act. The act was always criminal; it does not become criminal only when discovered.
Likewise, civil rights violations are crimes that occur at commission...not when some court later happens to discover the violation.
"It's only illegal if you get caught," the criminal opines. The LEO agrees...and that is a very sad state of affairs.
All those people who sent form emails, all those people who sent email from a robot and fake addresses, those are merely members of grassroot organizations. They're obviously most important for determining the will of the people.
As for those people who send hand-tailored messages, well obviously they didn't care enough to send the very best. So they don't matter at all.
Perhaps I missed something somewhere, but to me it looks like nothing much changed. As I read it now, the government is basically saying, "Give us all the data anyway and we'll set aside any of it that we decide is too broad. Let's call the data that we set aside, 'not seized'; that should make you happy."
But I seem to recollect that "seized" means "taken"...not "taken and set aside." course, they did promise to look at it before they set it aside, then they promised to seal it until they have a moment to go get another warrant based on what they saw.

But it is certainly relevant to ask: If he was white, would it have happened at all?
It is certainly important to improve the justice system so it does not fail. But you can't do that, unless you identify the root cause of why the justice system fails.

It occurred to me after I wrote this that maybe we should start a campaign to get all ads banned at WMATA. It would be like a game: find two people who disagree about the subject of an ad, then file a complaint that it violates WMATA policy. (The part of the rules about public influence applies to any ad.)
WMATA’s advertising policies forbid, among many other things, advertisements “intended to influence members of the public regarding an issue on which there are varying opinions” or “intended to influence public policy.”
With that policy how could WMATA run any ad? For example, I might hate McDonald's, someone else might love it.That means there's a difference of opinion on McDonald's, and they are intended to influence the public, so MacDonald's ads are forbidden, right?
More and more it appears that the Marcus Hutchins indictment isn't about malware. It looks like the government is irritated with Hutchins and is using this as a cover to get even. Makes you wonder if Wanna Cry was a government attack.
Remember that old adage? This is what it means: when there is one rotten apple in the barrel, pretty soon there are more. Rot is a disease that spreads from apple to apple until the whole Barrel is rotten.
That is why it is so important to remove rotten apples from the barrel.
