Im not really quite sure where the Google/Facebook privacy bashing came from. Beacon and some wifi sniffing I guess? Both basially harmless compared to REAL breaches of privacy. What about Sony? What about the US Government, and every other government on the planet? Maybe I'm just griping about a ton of hypocrisy since most news publications that reported negatively on beacon store more personal data on their subscribers than that, and share it FAR more readily to their advertisers (to the point where they conduct studies about what demographics look at what sections first, and target those ads specifically). Also, neither Google nor Facebook have ever had a major security breach compromising their users privacy. So ya....
When you program with the mindset of preventing access to your content, its unlikely you will end up with a good access system.... it only makes sense.

You arent just selling the product, but managing that product in a customized fashion for your customer to give them EXACTLY what they need. Thats good, and exactly what Techdirt is about. Thats not what the NYTimes is offering. If as part of that 455 / yr cost you received additional access to round table discussions etc (ie: An NYTimes premium forum account) or whatever, i imagine that would be a worthwhile expenditure for some people, especially bloggers.

What about the default security settings for Windows Server? No JavaScript allowed on the internet. That would technically make Windows Server a 'circumvention device' along with NoScript. Thats an argument I suspect no one is eager to make in court...
As it was not designed to get around technical circumvention.... if it was then any older browsers would technically be circumvention devices, as would browsers on devices that dont support full javascripting. Also, how about the default security settings on Windows Server? I think there are so many devices that circumvent this paywall that any challenge would be meaningless...
You can call it legislating from the bench, but in the states doesnt the constitution override all, so as long as you call it into effect in your ruling you can be incorrect, but cant you not be overreaching? Isnt that why judges dont reference it unless they feel its necessary?
Im Canadian, and personally, who gives a shit what the New York Times does. The Guardian writes better news anyway, and seemingly isnt stupid enough to charge for something that they almost have to pay you to read now. Like, have they forgotten television? And internet based video news?
