The spying also includes the software making note of the channels you watch and when, which won't be solved with tape. I can imagine the conversation Junior has when he gets unsolicited ads in the mail from Playboy because he watched the Playboy Channel once and the spyware reported it.
Another consideration - can these locks be bypassed by holding a picture of the person up to the camera? That's fairly commonly case for nearly all facial recognition today.

I think he's pointing out one of the major fallacies of copyright maximalists: they want EVERYTHING to be owned and licensed... unless they used it themselves.

Spell check only catches if a word is misspelled, not when the wrong word is used. "I him tuna Canada Fry pedestrian" has no misspelled words at all, so spell check wouldn't help. A grammar checker might also help, but I've never seen a grammar checker that helped more than it hurt.
