Hate to incite more mayhem, but it's hard to believe that Pearson, too, might not have a 35-year-old skeleton in the closet... a stray morsel of random content owned by others, worthy of a reciprocal takedown. Search party, anyone?
Hmmm... in the UK, popular outrage nets a stiffer sentence. So when popular opinion indicates that charges are trumped-up, or that the law itself is unjust, vague or too severe, does the UK judiciary respond by downgrading the punishment? Twelve lashes with a soggy biscuit? If the mob causes judges to modify sentencing, hope that swings both ways...
Funny how in his appearance on "The Daily Show" last week, he actually stroked Spotify and seemed to acknowledge (positively!) that today there are infinitely more bands, more new music, than when the Beatles/Stones/Who/Kinks were the only bands pushed by the record companies. I actually wondered if he'd turned over a new leaf... but no, it seems.
Your Honor, let's go for broke on this one... plaintiff pays the Does' costs, and how about something punitive thrown in? There's no lesson learned if it's only Malibu's time and resources that are wasted; how about dipping into their pocketbook?
As the story notes, Tycho's real fear over the cash outlay was the inability to gauge the fans' response... to predict revenue. That's a story as old as performing itself, and while crowdfunding is a new twist, it's hard to believe that would work in a majority of cases. The Irish singer/songwriter Luka Bloom actually does something similar for American trips... except that the crowdfunding is substituted with a bunch of low-expense, high(er) revenue home concerts -- where fans pay that extra amount, over and above the typical ticket, that they might have sent for airfare. Crowdfunding airfare is innovative, but it's hardly amazing... wait... where my shift key... AMAZING.
The real story here, and why Mike no doubt highlighted it, is CwF. Big as life. Can't make better connections than these, whether donated airfare or a face-to-face home concert; and that's the way today's artist really thrives.
... apparently, if you're looking for standing in an Eastern District of Texas trollroom... err, courtroom. A quick consult with Uncle Google returns not only Uniloc themselves, and a small pile of IP law firms, but this tidbit: This same office/retail complex is the site of this year's 16th Annual Eastern District Bench Bar Conference! Link to a PDF copy of the program:
Highlights for me: a panel on "East Texas Ethics & Ettiquette"; and another panel featuring someone called "Scrappy". That's a whole mess o' down-home, good ol' boy rustic charm. Oh, yeah, and a little bit o' lawyerin'.
This NEEDS to be the next big Techdirt giveaway... a trip to Plano! Imagine getting to hear and see all the nefarious doings we readers follow every day... maybe even spotting some of the protagonists in person! I'd plan a trip right now, if I wasn't so worried about walking away demoralized and suicidal...
Kind of makes me feel bad. OUR standard Consent and Release:
"...To use and reuse the photographs and /or recordings in whole or in part, in composite or distorted form... To use my own or a fictitious name in connection herewith if Producer or any of its designees so choose... I hereby release and discharge Producer... from any and all claims and demands... this includes, without limiting the above, any claims for libel, slander, defamation..."
Something about that letter... the fonts, the ad-like layout, the cheesy look of a mass-mailing high-speed laser printer... reminds me of postal mail our office receives on a near-weekly basis. The return addresses claim (with permission) to be from veteran's charities, MADD, Vanished Children's Alliance and other legitimate entities; but the envelopes are identical, the paper stock and bad printing identical. They're actually from a Texas-based boiler-room outfit, which pays charities mere pennies from the donated dollar. It feels sleazy... cheapens those participating charities.
"This isn't a dying business, this is a changing business..."
Etch it in granite, put it on billboards, make T-shirts and hats... this is the message so many have missed. And Braun will continue to clean up, because he's tuned-in to the new method.
Flip side: A plant would have days... weeks... in advance to create profiles and such... why wait til the event? I've created last-minute logins for special content that interested me.
My wife's grandmother used to say things like, "You can have that necklace after I move to California," although she was referring less to a cross-country move and more cross-dimension. Marilyn, of course, has already moved to California, where, no doubt, she's met my wife's grandmother.
Re: If you really are upset by this you need to relax
Thanks for your moderate tone and appeal to logic. Is well-executed questioning the most effective method? Very, very likely. Is screening hardware an immense waste of time and money? Absolutely. But if the question is...
"I honestly cannot understand why people would be upset by this pilot program..."
... then I think you showed us that you know the answer:
"... the TSA agents I have encountered... are completely untrained (to) properly perform this type of questioning."
Please understand that this is why we're upset... a pilot program sans training is no pilot at all, like actors holding a dress rehearsal before the auditions are through.
And remember that after the Continental merger, they now have TWICE as much data to lose. COA had their snarky moments, but I don't recall a total system wipeout.
Here's an idea: We've all heard about the Fabulous DEA Impound Lot, full of Porsches and Maseratis... just open the trunks and glove boxes, and look for shopping bags from Best Buy... gotta be a couple of petabytes' worth.
Proceeds of the judgment should be used to correct the terrible conditions that led to this crime: re-establish a system where music is sold only as a shrink-wrapped, physical product, in brick-and-mortar stores. That ought to end this hooliganism.
