It seems to me that if Monsanto did not want the seeds of their plants being used, they could have engineered the seeds to produce a plant that does not germinate. Since they did not do this, they sold a seed that was expected to eventually produce seeds. They should have known that this would happen and adjust their license fees appropriately.
Unless, of course, the seeds are versed in contract law.

Eh, we both know it won't succeed. If it looks successful, the media companies will pull their content and try to create their own service so they can get all of the revenue. They are just letting Youtube do the market research for them.
I can see them talking now: If we file a bunch of cases now, Judge Wright can't tell on us to those judges because the order said "pending cases." These weren't pending at the time.
Given her recent responses on her tumblr account, I'm more inclined to want to see her get some credit and compensation. She is stressing that she doesn't want Disney or the media contacted, and that she feels uncomfortable with the attention. Even though it is based on a classic character, in the painting she is painting the roses white according to her, as part of a different story she was trying to tell.

Those who produce must also provide the means for their product to get to market. We don't expect everyone to drive to Hershey, PA for a chocolate bar, Hershey has a supply chain that reliably distributes their goods to a market place to be bought and consumed by a grateful customer.
The problem here is that DRM is providing a less than reliable market. Too many people are gun shy about purchasing material with DRM when that same DRM that restricts your use of their product and supposedly prevents piracy can also remove your access to something that is purchased. When the local tower records closed, they didn't come and take the CD's I had purchased from them back. But that is basically the same thing that is happening here.
I have had a lot of complaints about Shonen Jump Alpha about how they handle certain things. But recently my subscription expired and I don't currently have the extra money to renew at this point. I also did not read the last 2 issues before the expiration, so I figured I was out of luck for those. But this weekend I opened the app and it still allowed me to download the ones I had subscribed to but not downloaded before the end of my subscription. I was impressed that they seem to be doing that very well, when most digital services these days cut you off.
My guess is they will want to charge the ISP based on the total number of outgoing emails from the provider. Then the ISP will charge based on some kind of average claiming they don't have the technology to keep count of the number of emails per person. So guess what, you'll finally get to pay for the people who's computer has been hijacked and is sending spam by the millions.
I can see the new business model already, "Buy our new ED herbal pill, when 10,000 buy we'll stop sending spam."
Or if they do keep track of who sends what, the new ransom ware: "Send us a money pack number with $50 or we will send 1 million emails a day from your computer until you do."
We need to start taxing HDTV's in order to save the SD cathode ray tube business. Doesn't anybody think of the poor children who won't grow up with a TV that weighs more than they do?
Sadly, you are probably right. They are more likely to spend money trying to break up large pre movie viewing parties at people's homes that are watching the original on dvd before heading to the movies to see the new one than to do anything sensible.

I would think that given a possible fraud, the judge would be making this such a tight deadline to prevent Prenda from having time to find someone named Alan Cooper and getting him to play along as THE Alan Cooper. Because even if they found an Alan Cooper, they would have to have time to get him up to speed and get enough of a paper trail to pass him off.
I'm more than half expecting bench warrants to come out of this. I wonder if anybody is trying to set up a live blog for this? I'd watch.
Heaven forbid that this movie look or remind anyone of the original and evoke warm memories that make them want to go out and by yet another copy of the original with new extra super duper color enhancement. We'd much rather spend money on lawyers trying to stop it than make money with a new release of our old movie.
Heck, if it was me, I'd be trying to get in on the deal and re-release the original and encourage setting up double features.
