Aiding & Abetting
So, given this particular train of logic....all US telephone carriers should be found guilty of aiding & abetting every single drug transaction ever arranged using their network. They provide the technology and even though MOST of the uses are legitimate, they ABSOLUTELY KNOW FOR A FACT that some of their users are committing crimes using their technology. Ipso facto - they are aiding & abetting.
AT&T, VERIZON, etc - go ahead and turn yourselves in at the nearest PD. I'm sure you'll be treated fairly just like MegaUpload has been.

Witch Hunt
Tie them to a pole and dunk them underwater! - if they survive they are a witch & kill them! - If they don't....well at least they died without being a witch!
Megaload - Seize all his assets and extradite him to the US! - If he is convicted (because he can't afford a decent defense after the US seized all his assets) then he was guilty all along - If he successfully defends himself....then he's got something else going on so repeat again from the top!

ATT owes someone a CRAPLOAD of money!
Based on the judge's interpretations of law in this case, AT&T may be held CRIMINALLY LIABLE of facilitating the "Nigerian Prince" scams since it provided the technology and ability for the actual criminals to use.

STUDY PROBABILITY THEORY
I could randomly pick boxes and have a better detection rate than that. They must be working pretty damn hard at screwing up to hit that low a percentage!

That's just stupid!
Adding a separate charge for video transmitting a murder to decrease the number of murders is like tacking a parking ticket on top of the bank robbery charge because of the get-away car out front. NEITHER IDEA WILL STOP ANYTHING!

Quit arguing over details
If I coat a letter with peanut oil knowing the recipient is allergic to peanuts then I am guilty of attempting to harm that person and the specific charge would depend on how harmful my actions were.
If this idiot sent the .gif knowing (OR EVEN JUST BELIEVING) that the receiver is prone to bad effects of strobing lights then charges may be considered just the same as the peanut-oil letter.

The only way to stop this stupidity
is to pass laws making the INDIVIDUAL responsible for any fines received for willfully ignoring the law. Fining the AGENCY has no impact upon the employee so there is zero incentive to actually DO THEIR JOB and OBEY THE LAW.
