As I read this I couldn’t help but think about the “Wild West of the internet” claims we have so often heard.
Then I was reminded of traveling across Nevada when I was younger and you would have to go through the small towns with their speed traps where one mile per hour over the posted limit (usually 25 or under, and on a sign partially blocked by a tree) would get you a ticket. I suspect they made lots of money with this practice as most travelers were unlikely to return to argue their case in court and would just mail in the requested fine amount.
If you take Apple and Amazon and make this comparison only looking at tablets and content then perhaps Apple has the better strategy. The problem is of course that you can't do that.
Even if Amazon ends up lowering the prices on the digital content they still have people on their site seeing their other products etc... Amazon can afford to set the whole tablet and content package as a loss leader to get customers in the store and then sell them candy, shoes, and frying pans.
Amazon doesn't just want to sell you tablets and content,they want to sell you everything you buy.
It seems that the imbalance in arbitration (and I have seen the question of imbalance talked about alot with the recent change to EBay's TOS) that if someone were to create and publish a list of the actual ratios of the decisions of arbitrators in favor of corporations vs individuals, it would be very helpful. Might force a leveling out where arbitrators would strive to have a 50:50 balance so both parties would choose them.
You need to remember that IP maximalists are always driving and pushing for more control. It is easy to dismiss their single mindedness as simple mindedness, indeed that is part of the purpose of their trolling but this is a great example of how they work. The idea is to start to introduce the concept that anything that to "process" 1 s and 0s is some mysterious black art that only Hackers and Pirates would use. These mysterious "decoding" tools must be taxed/regulated/stopped/banned and their users punished.
Unemployment being what it is sounds like you have a solution that might help. If your program sucks and fails you are responsible. Either fix your code or do it manually.
I would expect to see a rise in proxy services in the countries where this is available just to satisfy people like yourself, possible including a "local address" so you can subscribe.
