He's wrong on one point. I don't expect law enforcement to prevent crimes from happening. I expect them to apprehend people after crimes have happened. Their success at apprehending criminals is what prevents crime - knowing you can't get away with it.
The attitude that "we must prevent crime" is the same attitude that makes everyone a potential suspect, since anyone is capable of committing a crime.
ALL fair use must be determined on a case-by-case basis. That's one of the problems with fair use. Just because nobody took Jon Stewart to task doesn't mean he was immune from lawsuits. And if his show wasn't comedy - more people might have taken issue with his use of copyrighted content. And since most fan fiction is parody, that puts most of it squarely in fair use territory.

Some people believe that since utilities are a monopoly they're bad and if there were competition for things like water and electricity, it would be cheaper or the service would be better.
