If this were held valid, then any photo (news broadcast, etc etc) in a public place which showed (for example) a trademark logo on a vehicle driving by would be unusable other than by the vehicle's manufacturer (and they couldn't use it either, if it also showed a trademark belonging to ANYBODY ELSE). (Actually, since those vehicles have design patents or copyrights, any vehicle with an identifiable manufacturer's design would be illegal too)./div>
