From the 8th Circuit opinion, “In August 2018, someone lodged a formal complaint against Ness for possible violations of the harassment statute, Minn. Stat. § 609.749 (2019), based on her recording and photography at Smith Park. The City did not file charges against Ness at the time.”
I was at the park, with two grandchildren, there were 4 neighborhood children at the park too. These children live behind me, I say hi to them while in their back yard, while at the park. They have approached me before while strolling the grandchildren when they were babies, and while one of the grandchildren, at 3 years old, was riding a bike.
One of the children said my name, I said hi back, another said, aren’t you afraid of her, and I said I am your neighbor, I live behind you.
The next week there are 3 officers at my door. I was informed by one of the officers that they have an obligation to follow-up on felony reports, and that they don't just get general misdemeanor cases.
I spoke to children who approached me, who said my name. I was being neighborly.
Later I found out, through a data request, that it was the ex director of the school who called the police and the police wrote up a citation.
The report states, "harassing a group of juveniles by video taping them at the park, and asking them their names. She pressed on by asking them where they lived, and what their address was. She attempted to get them to point to their address on Park Ave S."
I did not harass them or stalk them. I did not video tape them, I did not ask them their names, I did not ask them where they lived or what their address was. I did not get them to point to their address on Park Ave S.
It is very difficult to read articles about the case, it is like the telephone game where at the end what is said is not close to what was originally said.
The following is a blog link where a councilmember questions if it is fraud when someone makes representations to entice someone to make a contract and then they don't follow through with what they promised. The City Attorney inaccurately replies that the person at the hearings, probably didn't have legal authority to make the representations he did.
