    Possible DMCA or CFAA issue?

One issue is that, as it's dealing with computers, there may be a possibility this could run afoul of the DMCA Anti Circumvention clause (they are circumventing the purpose/intent of the exam). Parts of the DMCA are so poorly, or broadly, written that many things violate this DMCA clause.

At the very least, this could be cause for charges under the CFAA, again, because it is dealing with computers. This was a big favorite to charge everyone with, before the DMCA.

This is what happens when a bunch of know-nothing lawmakers watch the movie Wargames, and freak out.

    Re: Re: not a crime

Remember. Courts have ruled that Police don't need to know the laws they enforce, or arrest people for. Next logical step is that courts don't need to know either.

    What's next? Accountability Reclamation Fee?

Here's your refund of $1,775, and a bill of $5,000 for Accountability Reclamation (which we've already withdrawn from your bank). Assessed for each occurrence of an ungrateful customer daring to expose our incompetence to the Media/Public after we jerk them around.

I still think these politicians should be the first ones to take their own medicine. If they want encryption to be banned, or severely crippled, they should be the first ones to access their financial data, or anything else, strictly over HTTP or Telnet, no HTTPS or SSH allowed. Unrealistic, but their data at those institutions should also be stored unencrypted and easily obtainable, since encryption is so bad and evil.

Completely unrealistic I know, and would likely lead to more of a "class" system. Where politicians and the elite are allowed to have encryption, security and privacy, while the rest of the serfs only get to use weak, or no, encryption.

    The next terrorist attack...

Would that be a real or manufactured one?

I keep hearing about all the terrorist plots being foiled by the FBI, in which it turns out the FBI thought up, planned, recruited/coerced the actors, supplied them and then "foiled" the attempt through investigative means.

Would this possibly mean that they may plan some attacks using encrypted communication with the actors, that they then are "unable to prevent" because of "encryption", just to further their Totalitarian/Orwellian agenda?

I swear, I'm only this cynical when it comes to the Government/Politicians. They, long ago, abandoned the purpose of "Serving the People", in favor of serving themselves.

    Other possible gateways?

Hmm, file sharing is a "gateway to more criminal activity"? Did they poll every criminal and determine that they had, at some time in their life, shared files?

If that's the case, then there are far bigger fish to fry. I can guarantee that probably 99% of the criminals went to school. So, schools must be a gateway to criminal activity. For that matter, I can state with 100% certainty that every single criminal had been born, so...
    correlation is not causation
Yeah, well if politicians didn't rely solely on correlation, they wouldn't have very much to try and start a moral panic with, which they need to advance their own personal agenda.
