You don't need forfeiture. Just make it a crime to knowingly give your car to someone you have reason to believe shouldn't be driving. Then the owner can have due process in court when they're prosecuted, instead of having the weird exception of a parallel justice system that circumvents the constitution.
Once you've got the guilty verdict after due process, then you can decide what's an appropriate sentence and I'm sure someone will suggest the idea of taking the car, if that seems like the right thing to do, given the circumstances./div>
