What's Wrong with Meta-Tags?

from the UK-and-litigation dept

The UK high court has ruled that the use of trademarks in meta-tags is illegal. In the US, playboy lost it's case against meta-tags but it seems that the UK is continuing its tradition of over regulating the internet.

Thank you for reading this Techdirt post. With so many things competing for everyone’s attention these days, we really appreciate you giving us your time. We work hard every day to put quality content out there for our community.

Techdirt is one of the few remaining truly independent media outlets. We do not have a giant corporation behind us, and we rely heavily on our community to support us, in an age when advertisers are increasingly uninterested in sponsoring small, independent sites — especially a site like ours that is unwilling to pull punches in its reporting and analysis.

While other websites have resorted to paywalls, registration requirements, and increasingly annoying/intrusive advertising, we have always kept Techdirt open and available to anyone. But in order to continue doing so, we need your support. We offer a variety of ways for our readers to support us, from direct donations to special subscriptions and cool merchandise — and every little bit helps. Thank you.

    ffs..

So let me get this right... If I lived in the UK and put up a site that contains information about Coca Cola and I put Coca Cola in my meta-tag, I'm commiting a crime? I mean c'mon.. this is getting really pathetic.

Wrong. If you are a profit-oriented business, and you put your competitors' trademarks in your meta tags with the intent to confuse your competitors' potential customers, then you are commiting a crime. For instance, Pepsi makes Mountain Dew. If Coca-Cola put "Mountain Dew" in their meta tags, they would be violating Pepsi's trademark.

      Just biz as usual

I agree with both of you, the UK legal system just doesn't get it. I like the UK because it has a lot of brilliant people but it's the legislation, as well as the taxes that's stopping it from being a lean, mean e-machine.
