Do Laws Of Trespass Cover The Internet?
from the interesting-questions dept
An interesting opinion piece from the Financial Times looks at whether or not we need special laws concerning "internet trespassing" or are current laws sufficient. I have trouble with some of his arguments, because I do think that the internet is, in many ways, different than regular property. In general, I have trouble with arguments that say someone should resort to laws in order to keep someone off their website. There are technology solutions, and I much prefer to see companies put them to use. If you don't want others accessing your website, then you shouldn't go online. In the case of Hamidi vs. Intel, though, I do tend to side with Intel - but not based on the trespass claim. I think they could get Hamidi on an unsolicited email claim, instead, for spamming so many of their employees.Thank you for reading this Techdirt post. With so many things competing for everyone’s attention these days, we really appreciate you giving us your time. We work hard every day to put quality content out there for our community.
Techdirt is one of the few remaining truly independent media outlets. We do not have a giant corporation behind us, and we rely heavily on our community to support us, in an age when advertisers are increasingly uninterested in sponsoring small, independent sites — especially a site like ours that is unwilling to pull punches in its reporting and analysis.
While other websites have resorted to paywalls, registration requirements, and increasingly annoying/intrusive advertising, we have always kept Techdirt open and available to anyone. But in order to continue doing so, we need your support. We offer a variety of ways for our readers to support us, from direct donations to special subscriptions and cool merchandise — and every little bit helps. Thank you.

If were're going to have internet trespassing laws
Actually, I'm in the hackers suing the corps. camp on that one, but it could easily apply to all those poorly configured wireless access points as well.
Don't get me started on my "maintaining a honey pot is entrapment" rant...
