Do Laws Of Trespass Cover The Internet?

An interesting opinion piece from the Financial Times looks at whether or not we need special laws concerning "internet trespassing" or are current laws sufficient. I have trouble with some of his arguments, because I do think that the internet is, in many ways, different than regular property. In general, I have trouble with arguments that say someone should resort to laws in order to keep someone off their website. There are technology solutions, and I much prefer to see companies put them to use. If you don't want others accessing your website, then you shouldn't go online. In the case of Hamidi vs. Intel, though, I do tend to side with Intel - but not based on the trespass claim. I think they could get Hamidi on an unsolicited email claim, instead, for spamming so many of their employees.

If were're going to have internet trespassing laws
Actually, I'm in the hackers suing the corps. camp on that one, but it could easily apply to all those poorly configured wireless access points as well.
Don't get me started on my "maintaining a honey pot is entrapment" rant...
