Intermix Wises Up, Settles Lawsuit Concerning Sneaky Installations

from the what's-the-definition-on-that? dept

Originally, it looked like Intermix thought it could fight back against the charges from Eliot Spitzer by pretending that he was claiming they did something different than he actually accused them of doing. They said they weren't "spyware" because their app didn't do any "spying." Of course, that's not what they were charged with. They were charged with doing a surreptitious install with their toolbars, annoying lots of people who didn't want pop up ads from Intermix and never agreed to them. It looks like Intermix realized that a court of law wouldn't buy their weak attempt at misdirection and has agreed to settle the case, paying out a few million dollars and promising to stop distributing adware and to "redirect" all existing ad programs (though, they don't say to where). Of course, without the sneaky adware installs, it's not at all clear how the company intends to make money.

Thank you for reading this Techdirt post. With so many things competing for everyone’s attention these days, we really appreciate you giving us your time. We work hard every day to put quality content out there for our community.

Techdirt is one of the few remaining truly independent media outlets. We do not have a giant corporation behind us, and we rely heavily on our community to support us, in an age when advertisers are increasingly uninterested in sponsoring small, independent sites — especially a site like ours that is unwilling to pull punches in its reporting and analysis.

While other websites have resorted to paywalls, registration requirements, and increasingly annoying/intrusive advertising, we have always kept Techdirt open and available to anyone. But in order to continue doing so, we need your support. We offer a variety of ways for our readers to support us, from direct donations to special subscriptions and cool merchandise — and every little bit helps. Thank you.
