Alleged Ax-Murderer Claims News Reporter Violates His Likeness Rights
from the publicity-rights-gone-mad dept
In the latest example of "publicity rights" gone mad, a guy on trial for murder, David French, has asked that a judge in the court order a TV news reporter to turn off his recording equipment because he doesn't want his story told in the press before he gets to write a book about it. As the anonymous submitter of this story noted, "presumably, French is unaware that, if found guilty, the "Son of Sam Law" would prevent him from profiting on any such book."French said the reporter had no right to record the trial because French may want to write a book someday and doesn't want media telling the story first.Thankfully (but not surprisingly), the court shot this down pretty quickly, pointing out that cameras are allowed in the courtroom.
"The court is allowing a commercial entity to make money off of this," French said. "They don't have a right to my name, likeness and ... story."
Thank you for reading this Techdirt post. With so many things competing for everyone’s attention these days, we really appreciate you giving us your time. We work hard every day to put quality content out there for our community.
Techdirt is one of the few remaining truly independent media outlets. We do not have a giant corporation behind us, and we rely heavily on our community to support us, in an age when advertisers are increasingly uninterested in sponsoring small, independent sites — especially a site like ours that is unwilling to pull punches in its reporting and analysis.
While other websites have resorted to paywalls, registration requirements, and increasingly annoying/intrusive advertising, we have always kept Techdirt open and available to anyone. But in order to continue doing so, we need your support. We offer a variety of ways for our readers to support us, from direct donations to special subscriptions and cool merchandise — and every little bit helps. Thank you.

"The trial is unusual because the defendant is transgender and the defense and prosecution are using different pronouns. Defense attorneys refer to French as a "she," which is the orientation French identifies with. The prosecutor refers to French as a "he," French's legal gender. "
"Snowden, the prosecutor, said Johnson wanted French to move out of the cluttered one-bedroom apartment in the 5700 block of North Kerby Avenue. The night of the killing, he confronted French. Johnson had found another transgender individual he was romantically interested in. "
