But you also can't replace them as easily if someone manages to copy the pertinent biometric data. "Oh, someone else has my 'doorkey' now, I'll just hack out my eye and sew in a new one" :-)

And that I'd be suprised if it took much longer than hours for the average release to appear on file sharing networks, I'd be inclined to agree with you - kinda hard to see a causal ramp in data if the 2 "releases" are more or less simultaneous.

Artful at best. While the law may not have technically expanded its scope (I wouldn't know in legal terms IANAL), there is no doubt whatsoever that it has expanded in intepretation and regularly encroaches on other pre-existing rights like the doctrine of first sale.

But just to ruin an already crap anlogy even further, research tends to show that driving a little over the posted speed limit can in fact be statistically safer since posted limits often do not meet the 85th percentile speed for the road.

I am trying to buy some films I remember fondly from the '80's. They all appear to be out of print on DVD and unavailable to buy as a download. They also appear to be unavailable for streaming on all the streaming services I'm aware of and besides the quality on those suck on my very large television. I want a good quality copy that I can buy, keep, play on any and every device I currently own (many) for the rest of my natural (or unnatural life). With your "growing sector providing consumers with content when they want it, where they want it and how they want it", perhaps you can help me out with that? As an added incentive, if you can provide me with these films I am looking for at a sensible price (since you made your money on them in the 80's) I promise your chances of getting me to buy still more will go up by an order of magnitude.

Self interest is a powerful motivation, which is why an "independent" judge and jury and not victims of crime get to decide on guilt and set the punishment. There is always a problem when the people with the most direct interest get to set the boundaries. Objectivity in law is dying a sad, painful and drawn out death in most western democracies.

But the spectrum is locked down in a given area. A company may have the sole rights to use the 1.8GHz spectrum in a given area and even if they have excess capacity in that area, no one else is legally allowed to use that bandwidth.
If that's the case in the states it's very different from the UK.... air is air and the permission bit for a providor is being allowed to erect a cell tower in the area, which mostly only get blocked by resident protests... most of the major providors cover over 90% of the country to some signal level

no company has sole unlimited use of I-80 in the US. It is shared for better or for worse by all of them.Yes and no one company has sole use of the 1.8GHz spectrum, it's shared by all of them. In the (imperfect) analogy, the number of transmitters a providor has would be roughly analogous to the size of fleet of a logistics company, the amount of roads to the amount of bandwidth allowed by the government for mobile phone use.
