The point is, IP maximalists frequently infringe while demanding harsh punishments for infringements and even things that are clearly fair use. The trademark maximalists are wildly and ridiculously overprotective.
But yes, aside from time limits, there are a lot of other things that need to be addressed in those systems.
Still, exfiltrating trade secrets does not remove them from the original holder. Still not theft per se. Unless you literally have something written on one piece of paper in a safe and someone absconds with it, and no person actually knows the secret operationally somehow, you can't steal the secret. You may steal materials, or copy data, but saying it is the theft of ideas does not make it so.
And that is exactly what these types always bang on about.

The challenged agreement is between the US and EU. The spying of other parties is not even relevant. The USG is making it impossible, and that is the problem for the agreement.
Actually i find it kind of funny that people think political and economic flavors are really the main thing driving governments. Communism, lol. They weren't even good socialists.
