It's not modding in the technical sense. Because the actual hardware isn't modified. Those cards you put in the DS don't harm the hardware at all, they work just like a regular game, the producers only retrieved the security codes that Nintendo placed on the DS-cards in order for those cards to run.
If Nintendo was smart, they'd release a card that would allow for homebrew software to run on it, but not the 'illegal' ROMs. That way they can point to that, as an "approved" alternative.

Everyone can have an opinion, and everyone is allowed to state that opinion, even if the company in question doesn't agree with it. That is covered in freedom of speech.
This legislation is more like a disease or a virus, the way it spreads around the world.
I find it hard to understand how it can be that different governments suddenly start to write new copyright laws so close after eachother.
And I find it even harder to understand why these governmental agencies don't look at more experts, rather than just lobbyist from one side of the equation.

I'm going to assume that the campaigns are better, and that they are especially objecting to the scans to replace worn pieces. Because that's when Games Workshop is "losing money", as the players don't buy complete sets to replace just a few worn pieces, anymore.
But it's a sad state that even games companies are now run by the legal department.
I'm almost sure that none of the board members of "Games Workshop" ever played a game of Warhammer in their life.
This year, I spoke with Tim Kuijk (the spokesperson of BREIN) on the subject of legal alternatives for sites like The Pirate Bay and Mininova, and he states that he believed there will one day be a legal alternative, but not within the next 4 years. So I'm going to assume we'll at least have 4 more years of wac-a-mole.
Actually there is already a problem. Right now you have two big formats competing... Adobe's EPub and "Amazon's" Mobipocket. Both have DRM, but Amazon's license stipulates that you can't have Mobipocket DRM on your device next to any other DRM.
So you can only have a EPub Reader or a Mobipocket ereader device.
Right now I have a Bebook ereader with a firmware version that supports .mobi pocket, but most ebook providers in my country prefer .epub. And there is a firmware version available that supports .epub, but that strips the mobipocket drm support from the device.
The problem is that I already have books in DRM'ed .mobi format.
Of course I could alternate between firmwares, but that's like juggling with fire, something is bound to break at some time.
Or I could somehow circumvent the DRM on those mobipocket books and possibly violate a law or two. Not sure which is worse, the piracy of downloaders or this kind of sellers piracy.
I take it, you are not a fan of full disclosure.. I am, and I think it should be everyone's duty to report on flaws such as these.

THEY'd come out with a cartridge that would allow for homebrew applications. But since all the big media corporations are built on greed (and Nintendo isn't any different), they refuse to do that, as they wouldn't make money on those free apps.
From what I heard, services like Dropbox don't even work in South-Korea. No online backup system is allowed in that country as it could potentially be used for illegal filesharing.
I'm now less inclined to go and watch that movie. If the fans are being heckled by the director, he is not worthy of my money. (to my knowledge that movie isn't yet in the Dutch and Belgian movie theatres: IMDB reports a release date of 14 January 2010)

Did you try to watch their coverage? It was solely MTV 'VJ's strutting their stuff in front of a crowd, instead of any of the music, except for tiny snippets every once in a while.
It was just ads and talk tv.
