Mike expressed disagreement with Kerr in a thoroughly respectful manner. He did so in three paragraphs of a 13-paragraph post. To say that "Mr. Kerr was berated here because he had the temerity to express his opinion" grossly misrepresents the tone and the content of Mike's disagreement and the context in which it was voiced.
Wholly apart from this disagreement in the past, I fail to see why someone who does something admirable should not be admired for it.
For what it's worth (because I know people will bring it up), lawyer and legal scholar Orin Kerr -- who I greatly respect, and often agree with -- has published a series of pieces in which he argues that the case and the prosecution had merit, even if he still believes strongly that the law it was based on, the CFAA, is greatly in need of fixing. Kerr's opinion is one such opinion -- and while interesting and well thought out, it fails to convince me for a couple of key reasons.
That's like saying that Federal Express and the Postal Service has been a major contributor to the success of Ebay or Etsy or whatever.
Do Federal Express and the Postal Service maintain a web storefront for Ebay and Etsy where you can buy all of Ebay's and Etsy's works? Do they include tracks by Ebay and Etsy on the compilation CD's that they produce? Do they produce videos for Ebay's and Etsy's songs? Do they announce Ebay's and Etsy's new releases and activities to their Facebook friends and Twitter followers?
Lemaire's comment was clearly non-threatening. Note the lack of first-person ("I would like to burn TDSB to the ground...") or any call to action directed at others ("someone needs to burn TDSB to the ground...").
I'm a fan, Tim, but you're grasping at straws here. The distinction you make between what was written and these alternate ways of expressing the same sentiment is slender as a hair. The meaning isn't changed simply by using passive voice.

Newspapers are not like movies. Here's a real test: make a $100M movie and just give it away.
For some reason you are utterly fixated on this notion of a hundred-million-dollar movie. With very few exceptions, movies that cost that much to make are crap.
