That was some seriously insightful analysis by Julian -- makes me want to go read more of what he has written.
The connection made by proposing the algorithmic construction of non-copied sources perfectly illustrates why the current system is woefully trying to break down the wrong door.

I wasn't hitting the paywall I was told to expect in Canada, so I tested the waters by enabling JavaScript. Voila, I get a pop-over JS things after 20 articles. It wants to pay or log in or something.
The label prices are too high. The buyers at AllofMP3 weren't willing to pay those prices, but they were willing to pay the lower AllOfMP3 price.
This flies directly in the face of "people just want stuff for free," and indicates rather that people want things at a price they deem reasonable. This is up to the market (consumers) to decide, not labels. Except silly mechanisms like copyright monopolies prevent this kind of market balancing.
AllOfMP3 was doing the labels a favour by figuring out the real price people would be willing to purchase more content at.
25% of thousands of album sales at $2 is more than any percentage of ZERO sales at $10-$15.
If it is made increasingly uncomfortable/undesirable to work for the TSA, to the point where it becomes difficult to hire people, then perhaps the "Top" will realize something needs to change.
I've begun to take the same attitude with Bell in Canada. The employees need to be treated like outcasts from society until they quit, forcing Bell to cahnge tactics.

Perhaps next time 'round CC can command a higher price point, even with a larger number of units.
I've also always been a fan of the "private show" tier being offered by artists.

Disable JavaScript again: bye-bye pop-over. Continue browsing.
Enjoy, until they block this with some other countermeasure that will in turn be circumventing in this un-winnable (by NYtimes) arms race.

If it really gets so bad that your hyperbolic "ability to feed their families" begins to be affected, they leave the job for another.
If it becomes too difficult for TSA to hire/retain employees, they will be forced to change policy.
