Counterfeiting luxury items represents nearly zero losses to the genuine manufacturer. Those who can afford an expensive Rolex Watch are not going to buy knock-offs and those who buy knock-offs are never going to buy an expensive Rolex Watch.
Limited liability only protects individuals from being held personally accountable for a failed business. It does not protect illegal activities. Steve Gibson and others must be held personally responsible for what they have done.
I support what Todd Kincannon is doing. Righthaven needs to be held as an example so other would be scam artists and trolls will think twice about ever attempting something similar again.

Can you imagine Microsoft announcing that all applications and programs on any Microsoft machine must be submitted and approved by them? Why do we accept Apple doing this?

I don't mean to be a contrarian but I agree with him that he should be paid for his services, especially by companies like Warner Brothers. Warner Brothers don't like to give their services for free so even though the guy is brutally honest he is correct.
Working prototype should be required for any patent.
A working prototype should be a requirement for any patent. A simple description of an idea is not enough. I would even go as far as requiring a viable business plan as well as a capitalization plan to be in the mix as well.
There should also be milestones required by patent holders to meet or else risk losing the patent and patent holders who do not meet them should be subject to challenges by other interested parties.
Filing a patent with no intent to produce anything should carry heavy penalties since patents deny other who came up with the same idea independently.
Our Current Patant and Copyright Systems are un-American
There is nothing American about our current patent system. It destroys the pioneering spirit of ingenuity. Long patent terms stifle competition and give very little incentive to actually implement the invention.
Our current patent system is a form of government protectionism and does not conform with our ideals of self-reliance, free markets, competition, and the limited role of government. Inventors do not need government protection to be successful. Inventors and entrepreneurs do not need to be a protected class. The thought of someone needing government protection as opposed to competing in a free market should offend the sensibilities of all free thinking Americans.
We are becoming an extremely repressive society. Homeland Security was originally designed to fight terrorists but apparently has too much time on their hands so they have become the secret police of the copy-privilege industry.
It shows just how wrong our copyrights laws are when the creator of something can get sued for copyright infringement. If we are really interested in protecting creators then copyrights should be non-transferable and only apply to creators. Creators then can choose to licence their works to others but the licencees would only have rights according to the contract and no special rights afforded to copyright owners.
No other "right" is transferable so why do we allow copyrights to be?
Marketers understand that giving away stuff, particularly to high value customers, is extremely important for raising sales. Somewhere along the way the movie and music industries have forget this concept.
The music and movie industries need to stop listening to their lawyers and listen to their marketers who I'm sure are constantly frustrated with their employers constantly undermining them.
What they are doing is rendering studies useless if only positive results are allowed to be published. This effectively kills any credibility any study might have.
More of Rubert Murdock's war on the Internet. He hates the Internet pure and simple. He wants the Internet to be a deliverer of information only where users have no input.
Rather than cater to the market he wants to control it and force consumers to comply with his preferred business practices. In a free market it does not work that way. Someone who claims to be conservative politically should understand this.
Patents lasting for 20 years might as well be perpetual because any technology from 20 years ago is long obsolete. How many people are still using 20 year technology besides the music biz and their cd's?
Patents should last no more than 1 - 5 years and they should be absolutely specific. If you aren't actively developing a patent you should lose it after one year and be subject to lawsuits for the damages done to those who would have used it.
Our current patent system is destroying innovation, jobs, and billions of dollars. True creativity is being destroyed by endless litigation. Nothing is developed now that does not generate lawsuits from patent trolls.

The main difference between cartels and pirates is the cartels have the blessing of the government.
Often times piracy is the only thing that provides real competition which is why people are drawn to them when the cartels fail to deliver.
Piracy is the best indicator of an industry out of touch with its customers.
