One way that Apple customers can thwart brute-forcing a passcode is by resetting and wiping an iPhone after a number of failed attempts (I think the number is either 5 or 6).
This is a bad place for Apple to be: either have old, faulty batteries shut off phones unexpectedly at 20% battery, or slow the device down at peak usage. You really don't want to take a third option, as having it power through that might damage the battery enough to cause it to explode (Think Galaxy Note 7). Lithium batteries can be dangerous.
John Gruber linked to a podcast where a lot of people in the tech industry about what Apple did and what Apple could have done. Also, he linked another article where a backup and restore sped things back up.
I think you are confused. When broadband was under Title I, the FTC tried to intervene when ISPs did bad stuff, only to be told by the court that they can't. Apple policy regarding other OEMs was hardly an improvement.
What other OEMs were there? Apple's clone market ended up almost killing the Mac: people were buying the cheaper clones than the actual Apple product. And then Steve Jobs killed off the clones (and a lot of other product cruft).
From what I've heard on other site reporting this: they did it during first period, and those that do drugs sleep in, missing their first period. Leonard French covered this, and the comments are where this info comes from.

The podcast I linked earlier mentioned that there is a chip that's on the battery that tells the system the health of the battery.
