That's actually part of the point. None of it makes any sense, which is utterly pointless for anything other than profiting lawyers, and since small/new outfits are unlikely to afford decent lawyers, Big Content by extension, especially as they arethe ones writing this with no public consultation.
Economics is a 'science' the way Alchemy is a 'science'. It may lead to something real, but it has an awful lot of assumptions and guesswork in there.
Ok, I'm being a bit harsh on economics there (the problem is usually idealogically driven economists), but there is no way it's a 'hard' science - at best it's a soft science like sociology or elements of psychology.
The problem with caps is that they are too low for modern usage, especially given the lack of understanding people have for them.
Using a petrol (gas) analogy, imagine driving a car without a fuel meter or milometer. You would have to guess how far you have driven, how fast, to know when to fill it up again. Hardly ideal, is it?
If people don't know how big a Mb is, and their caps are too close to the bone, it all matters. If the caps were just to stop the worst offenders and therefore much bigger (like the telcos claim), then people wouldn't need to care.
