Look how long Prenda was able to carry on, even when it was clear to everyone else they were scammers Judges still took their cases and treated them like they hadn't pulled fast ones before.
IIRC the words of Judge Wright were still being passed around when Judge Howell decided that suddenly a case involving joinder issues & if her court was even the right place could carry on & authorized thousands of names be turned over.

The old adage is not to trust online reviews completely because people who had a great experience RARELY bother to post so those who do post had issues & expect something to happen as they scream into the void.
Twitter can't figure out what it is doing because Jack says one thing, the rules say another, some reviewers don't give a shit b/c they have 500 more complaints to handle in the next 30 minutes, if someone has power/position the rules ARE applied differently and the end result is the shitshow we have today.
Of course Jack's been starving himself & taking hallucinogens and has decided we shouldn't interact with people but with "issues" as if this will put out the dumpster fire.
There is a difference between threatening to slit someones throat & calling them out for being ghouls you feel are cashing in on tragedy they contribute to. They problem is now if someone hits the complaint button it is treated as if telling someone to fsck off is the same as threatening to shoot them in the head b/c their feels are hurt... Twitter is magically blind to the idea that the report skinner box didn't help them target the actual bad actors it just rewards them points for reporting first.
Imagine if the first response wasn't oh yes we will ban them because you feels were hurt but instead the system suggested block/mute. Freedom of speech means being able to say shit, doesn't mean others have to listen & it sure as hell doesn't say punish people if your feels were hurt.

But they saw this tech used on CSI and it spit out the answer in the first 5 minutes, so it must work.
Its a pity they no longer feel they need to do the job, they just wait for tech to hand them the answer.
Perhaps we need to require refresher courses on investigation, FSM they need refresher courses in how NOT to violate civil rights, how NOT to panic because the driver is black...

It wasn't about people judging each other, it was the idea that to monitor everything you have to hire half of the worlds population to watch what the other half are doing to make sure no one is offended.
We have turned shifting the blame to the deeper pockets into a cottage industry.
Sued Apple over a patent they never brought to market b/c it would have kept their kid from texting while driving and killing people.
Sued Grindr over the antics of a crazy ex-bf, but it appears never filed a police report about what he did... but found some magical way to blame the geolocation feature for causing the problems will absolving the crazy ex who kept posting the ads.
Sued Snapchat b/c if they hadn't made the filter that kicked in at an unsafe speed, their child wouldn't have broken the law to reach that speed & get the filter.
We need to bring back personal responsibility.
When a kid hits another kid with a stick, we need to stop campaigning to outlaw all wood. We need to punish the kid who swung the stick & teach them actions have consequences, not art therapy where we encourage him to draw his feelings about the big bad stick that forced him to swing it.

Perhaps the problem isn't the platforms, its the asshats posting to them... perhaps go after the asshats themselves instead of expecting the giant monolith to make sure you are never offended or upset.
Some people wanted to see the stream, most people did not.
People are more offended by the idea that some people wanted to see it and repost it than it was created.
Consider how all of the commentary has been about punishing the platforms for not hiring half of the worlds population to watch the other half of the population
rather than admitting we have racists in the world
rather than admitting for all of the spying on citizens for our own safety it has a big white blind spot
rather than admitting that we should discuss the hard subjects, rather than demand the world be filtered to please us
Tech can not wave its wand and solve all of the problems of the world. The simple fact that more and more people are falling into the tech will save us trap should be a huge warning as to how fucked we are. Perhaps instead of cheering them on when they claim their law is stronger than mathematics, we need to mock them for failing to do anything but trying shift the blame for their absolute failure to deal with issues.

How much money is in their coffers that remains there because they somehow can't locate the artists they are supposed to pay?
How much money is paid from their coffers to their staff who can't manage to do the job they obstensively paid to do?
They image a world where tech else can just glimpse something & decide if it infringes. but can't manage to locate artists they owe money to.
They find ways to nickel & dime the artists while blaming the boogeyman 'piracy' for stealing all of the money, while hoping we ignore their record profits.
Perhaps it is time to stop letting them be 'creative' in their accounting methods & demand they clean their own house rather than blame the outside forces who don't manage to get any of the money yet are blamed for stealing it while its just sitting in their coffers ready to buy more laws & give them bonuses for keeping the blame on anything but themselves.

I was chatting with some people on teh twitters who didn't seem to understand how broken the system was.
If you get a notice & don't jump immediately the penalties are laid out very clearly.
They thought you could counter-notice & get it put right back up... then someone looked at the actual law... and then they wondered how a 10 day window to restore material with no real penalties laid out was fair.
I told them if that made their heads hurt they shouldn't think about the billion notices Google gets everyday... when the notices are supposed to be sent to those hosting the material and funny Google doesn't host any of it... and they really shouldn't think about how DMCA notices have been turned into thinly veiled extortion attempts that if you refuse to forward on they sue you...
