As someone who worked in digital audio for a company who made music (MP3) players, I can assure you that you are *losing* quality/fidelity by re-encoding at a higher bitrate.
It could sound better to you, that's your taste. You're only doubling the number of compression artifacts though (original encoding + your encoding), and once that data is lost, it's gone for good.

These are excellent examples that should be mentioned more often in these discussions. They're making me rethink some of what purpose I thought copyright served.
You don't need to be a performing artist to make money from free music. Look at producers and engineers - they're paid for their service, not their goods. A professional songwriter would still be paid in that same way.
I think it would also help album sales if people could buy the remainder of an album for the remainder of the cost after buying a song or two. With digital files, the only overhead is an additional transaction fee, so why make people pay extra for completion?
